1. Acceptance of Terms

By accessing or using Crawfish API services, you agree to be bound by these Terms of Service (Terms). If you do not agree to these Terms, do not use our services.

These Terms constitute a legally binding agreement between you (User, you) and Crawfish Technologies LLC (Crawfish API, we, us). By using our service, you represent that you are at least 18 years old and have the legal capacity to enter into this agreement.

2. Services Description

Crawfish API provides an AI routing and gateway service that enables access to various large language models (LLMs) through a unified API interface.

Our Services Include:

  • Unified API access to multiple LLM providers
  • Budget control and spending limits
  • API key management
  • Usage analytics and reporting
  • Team management features

We act as an intermediary between you and the underlying LLM providers. Your use of the LLM outputs is subject to the terms of the respective model providers.

3. Account Registration & API Keys

To use Crawfish API, you must create an account and maintain the security of your API keys.

⚠️ You Are Responsible For:

  • Maintaining the confidentiality of your API keys
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use
  • Ensuring your API key usage complies with these Terms

API keys are for your use only. You may not share, transfer, or sublicense your API keys to third parties without prior written consent.

4. Payment Terms

Crawfish API operates on a pay-as-you-go, pre-paid credit model.

Billing Model:

  • Pre-paid credit system - you must have sufficient balance before making API calls
  • Usage is deducted from your prepaid balance in real-time
  • Prices are based on token consumption at our published rates
  • All fees are non-refundable except as explicitly stated herein

Refund Policy

Due to the nature of prepaid API services and the instant consumption of computing resources, all payments are final and non-refundable. However, we may consider refund requests on a case-by-case basis for exceptional circumstances within 7 days of purchase.

If we terminate your account for violation of these Terms, no refund will be provided for unused credits.

5. Acceptable Use Policy

You agree NOT to use Crawfish API for:

  • Illegal activities - Any unlawful, fraudulent, or harmful purposes
  • Content generation - Spam, malware, CSAM, harassment, or extremist content
  • Harmful activities - Creating weapons, facilitating violence, or promoting harm
  • Fraud & deception - Deceptive practices, impersonation, or scams
  • Attacks - Network attacks, DDoS, hacking, or unauthorized access
  • Abuse - Circumventing safety measures or rate limits
  • Regulated industries - Medical, legal, or financial advice without proper disclaimers

Additionally, you must comply with the acceptable use policies of all underlying LLM providers whose models you access through our service.

6. Service Availability

We strive to maintain high availability but do not guarantee 100% uptime.

Availability Commitment:

  • We target 99.5% monthly uptime (see SLA for details)
  • Scheduled maintenance windows will be announced 24 hours in advance
  • Unscheduled outages due to third-party providers are not under our direct control
  • We recommend implementing fallback mechanisms for critical applications

Service credits for downtime are limited to those specified in our Service Level Agreement (SLA).

7. Data & Privacy

Your privacy is important to us. Please review our Privacy Policy for complete details on how we collect, use, and protect your data.

Key points:

  • API keys are encrypted at rest using AES-256
  • We do not store the content of your prompts
  • Only token usage is logged for billing purposes
  • Data is processed in accordance with GDPR and CCPA requirements

8. Intellectual Property

Your Content: You retain all rights to the data, prompts, and content you submit through our service.

Our Platform: Crawfish API and its underlying technology, branding, and documentation are owned by Crawfish Technologies LLC.

Model Outputs: Outputs generated by LLM models are subject to the intellectual property terms of the respective model providers. You are responsible for ensuring your use of model outputs complies with applicable terms.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

IN NO EVENT SHALL CRAWFISH API, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

This limitation applies regardless of whether the liability is based on warranty, contract, tort, or any other legal theory.

10. Termination

You may terminate your account at any time by deleting it through your dashboard or contacting support.

We may suspend or terminate your account immediately, without prior notice, if you:

  • Violate these Terms or any applicable policies
  • Engage in illegal or harmful activities
  • Fail to pay fees when due
  • Pose a security risk to our systems or users
  • Are involved in fraudulent activity

Upon termination, your right to use the services ceases immediately. Unused prepaid credits are forfeited upon termination for cause.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by:

  • Posting a notice on our website
  • Updating the Last updated date at the top of this page
  • Emailing registered users (for significant changes)

Continued use of our services after changes constitute acceptance of the modified Terms.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Dispute Resolution:

  1. Informal Resolution: We encourage you to contact us first to resolve any dispute informally.
  2. Binding Arbitration: Any dispute not resolved informally shall be resolved through binding arbitration under the rules of the American Arbitration Association.
  3. Exclusions: Either party may take disputes to small claims court if eligible.

You agree to submit to the exclusive jurisdiction of the courts located in California, USA for the resolution of any disputes.
